In Germany, common law grants a 6-month grace period for landlords to return your deposit (kaution). Legal insurance is often sought by former tenants for protection against disputes with their former landlords.

However, legal insurance in relation to landlord issues comes with a 3-month waiting period on the Advanced plan and a 6-month waiting period on the Basic plan with the Home add-on.

If you have already moved out of your apartment, unfortunately, it is too late to take out legal insurance now to assist with getting your deposit back.

Let us explain why. The policy determines the initial cause of an event based on the date of the key handover. Due to the close proximity of the move-out date and the key handover date, we will evaluate insurability based on these dates. Due to this, any deposit disputes concerning this instance in the future would not be covered.

Suppose you moved out/handed over your keys on January 1st. After this date, your landlord has six months to refund your deposit. The more time passes, the more concerned you become. You now decide to purchase legal insurance in the event that you do not get your deposit back. Unfortunately, this event is pre-contractual and will not be covered.
